Aussie Lung Legality in the U.S. of A. . . ?

Yo,
Are there any restrictions for the selling of Aussie Lungs in the U.S of A? I found someone selling an Aussie lung, and the price is "affordable", but this is what the guy has to say:


It is 10 months old and 14 inches in size . It isn't microchipped so
no paperwork for it yet. I am able to ship it registered as captive
bred and a gift to a hobbyist friend so that all that chunk of
paperwork is not required at your end if bought.

Is F & W concerned with the sales of Aussie lungs, would they set up stings like they do for Asia arowana or is it legal to sell them? Wasn't sure the stance on this. Makes me a little nervous, don't want to send the money and then have the Feds show up at my door the next day.

Trying to give the guy the benefit of the doubt, just seems things aren't lining up right, and things are too good to be true. Plus 14" seems large for 10 months...not sure on growth rate, but that seems fast.

H2O had a few babies a few years ago and I don't recall any talk of micro chipping and I'm not sure what their status here is.There is only one breeder who is even allowed to export them from Australia as far as I know so they don't seem like the kind of bait that agents would use for a sting but who knows?Oddball can tell you more about them.

Generally speaking there are 2 reasons F&W prohibit commercialisation of a species:

1. conservation status (is it getting hunted to extinction?) as you said, asian arowana.
2. invasive species (is it going to wreck havoc on the natural environment?) think, piranha.

From what I have read, N. Forsteri are not endangered in their native habitat.

As for 2) invasive pest, that is a tough call and might be regional. In California, piranha, FW sting ray, and a variety of others (ie African Clawed Frog) are all unlawful in California. However in Idaho a friend told me he purchased his ray from the local LFS and piranha are common place. They can not endure the winter freeze and therefore pose no threat upon escape/aquarium dump.

If you're in a location where winter temperatures routinely drop below 0. It would be unlikely that a lungfish would be considered an nuisance.

Not an absolute, just speculation.

On a side note. Whenever the Gov't is involved in a sting operation over exotic import it is usually on items in the $1000's. As you said about Asian Arowana; some of those have been sold for a lot of money. The US Gov't is unlikely to be involved in a anything that could be considered a pocket change transaction (I am assuming by "reasonable price" you meant less than a few hundred dollars).

Go nuts and buy the thing. Just use my address for security reasons.

There are no restrictions for selling AULs that have already entered the US. You don't need to chip AULs. The chip is solely for aussie authorities to ensure that only permitted specimens leave Australia.
