I was testing an old heater for my tank to combat the ich infestation. Previous to this the heater did not work at all. I rested it on the bed to see if it would get warm. I was out of the room and smell smoke, I come back in to see the heater has burned INTO MY MATTRESS. That's through several layers of sheets. I was stupid and put it into my fish tank... It shattered. The heaters are not supposed to get THAT hot. Anyways... I ruined some sheets and I'm wondering if I can "sue" the company. It was a hazard to my health. What do you think? Thanks.:D

Sorry about your bed Chris. I wouldn't go as far to sue the company. That would take a lot of time and effort, probably not worth a couple burnt sheets. However, I would give them a call and tell them what happened. Demand some free products and a replacement heater.
 
presuming this was not a submersible heater...

you say it was old ? how old ? more than a year or so probly outta warranty. Leaves you with establishing on the balance of probabilities that a mechanical fault was present from day one. You gotta keep all the bits to do that.

and have it tested by an engineer.

and your recoverable loss runs to the heater plus new sheets - even though it may have been a hazard you thankfully wern't injured.

Gotta say I don't think its worth your while and would cost ya more than you're ever gonna get back.

of course if you went and had a nervous breakdown; now we're talkin !

(*sniff sniff*...I can smell an ambulance coming...back later *zoooooooooooooooom*)

i'm gonna play devils advocate here.

they will say that the heater was not being used as intended; i.e. in an aquarium as opposed to on a bed. they will say that the second problem of it shattering arose from you putting it in there it having been hot and not having cooled down.

but, I hope you get stuff from them :) :) :)

Thats what will happen.
But i still hope you can get yourself some free stuff
 
Most companies have warranties that exclude incidental damage from the product failing. That means the most you could get from them is a new heater. Also, the product did not fail, it worked perfectly. Almost any heater will also have instructions with it, and in the instructions it says never to turn it on while out of water, and make sure the heater is at the same temp as the tank before you put it in. I would chalk this one up to "Lesson Learned".
