I got this from this pet store I visit here in michigan. Has anyone heard this:

THERE LOOKS TO BE A LOOPHOLE IN THE LAW BANNING ASIAN AROWANNS FROM BEING IMPORTED INTO THE USA. THE Confederation of the International Trade of Endangered species ONLY LISTS Scleropages Formosus (THE GREEN ASIAN AROWANNA) AS BEING ENDANGERED. RECENTLY, THE OTHER ASIAN AROWANNAS HAVE BEEN RECLASSIFIED AS SEPARATE SPECIES:
Scleropages Macrocephalus: Silver Indonesian Arowana
Scleropages Aureus: Red Tail Golden Arowana
Scleropages Legendrei: Super Red, Chili or Blood Indonesian Arowana

SO IT WOULD APPEAR THAT UNLESS THE CITES APPENDIX II RULES ARE UPDATED, EVERYTHING BUT THE GREEN AROWANNA IS CLEAR FOR IMPORT.
NOTE THAT MOST OF THE COLORFUL VARIETIES HAVE BEEN FARM RAISED FOR DECADES AND THEIR IMPORT POSES NO THREAT WHATSOEVER TO THE WILD STOCK. FARM RAISED ASIAN AROWANNAS ARE TAGGED OR CHIPPED TO PROVE THEY DID NOT COME FROM THE WILD. SELECTIVE BREEDING HAS CREATED MUCH MORE COLORFUL SPECIMENS AVAILABLE TO THE HOBBY, JUST AS IT DID WITH DISCUS.

OMG!!! how could CITES not see that coming?!? hope it is true, cuz i'm heading to japan this this month and if they are legal now, i'm gonna bring me back acouple on the plane....heh
 
I wouldn't chance bringin any back until there is a clear pass other than a loophole. Even if you're not guilty, lawyer fees and wasted time aren't worth it for a fish. There's no common sense in a lot of laws. Call your congressman and give him/her a list of laws that need to change, you might be surprised. There's not a strong fish lobby in DC, but I bet you if enough MFKers called their congresspeople with justifiable arguments (like they are captive bred, etc) things may change. Pike cichlids were illegal in Texas for a while until enough people raised a stink about it...

Not true. ESA lists the reclassification names as synonyms for S. formosus. No matter the color, body shape, or scale patterning, all asian aros remain illegal to import, sell, transport, or possess in the US.

I believe unless the exporting country changes their laws, the lacey act still applies, correct?

The Lacey Act isn't the primarily legal impediment in the U.S., the Endangered Species Act listing is. A CITES certificate gets you around the Lacey Act, but it doesn't get you around the ESA. When the Asian arowana was listed in 1976, Scleropages formosus included all Asian arowanas. The subsequent description and resultant split of S. formosus into other species does not change the applicability of the ESA. :(
