one thing I HAVE to correct you on...so BAD INFO won't be seen as good...... CALIFORNIA LAW doesn't govern the NBA, in ANY way shape or form in the delegation of their by-laws ..... THE NBA IS BASED IN .....NEW YORK , LAST TIME I CHECKED , CALIFORNIA law ...DOES ..NOT ..APPLY in NEW YORK, anybody know something I don't on this subject?It's like talking to a wall. The only reason the NBA constitution exists and has any power to enforce anything written within its by-laws is because it is protected by the state and federal laws that allow said contract/constitution to be legally enforced. I don't get what is so hard to understand. The NBA is not a sovereign entity...when the NBA constitution was written...common sense would dictate that the lawyers/owners wanted to make sure that their constitution was LEGAL in all aspects of the LAW so that it would be ENFORCEABLE. You think that the NBA by-laws and the state and federal laws that protect it are mutually exclusive...when in fact they are not. Simple as that...look it up, seriously.
he is not pursuing...imo... the lawsuit because of the fact that a major sports league has never been legally overturned on a ban... THIS is the basis of MY ENTIRE ARGUMENT.... from the beginning, that's where the knowledge of sports history ...not a casual knowledge with CALIFORNIA LAW(pretty much , as of now proven to be irrelevant) will be the basis of this outcome....TO FINISH OFF MY THOUGHT...I(and EDDIE )were told by "many"on this thread about how we didn't know what we were talking about...and DONALD STERLING this.. and DONALD STERLING that...about CALI LAW(WHICH we seemed to be the only ones , who know doesn't EVEN APPLY to the NBA)...well these guys are about as easy to find ,now, as rats on a sinking ocean liner..or still claiming "we shall see" , hoping against reality ...how about even 1 of you heroes admitting MAYBE,,,just maybe ,you were looking at the wrong end of the donkey all along , and THE OTHER guy (s) were RIGHT all alongIt's a moot point if he's not going to take it to court to fight guys. The arguement was based on if the courts would uphold state/federal law vs. the voluntary foregoing of those laws when signing the ownership contract of the NBA. There have been many, many cases overturned stating that no matter the contract, you can not willing give up those rights. Other times the contract was enforced. Nothing like that has been overturned in sports before (that I'm aware of at least) so it would have been interesting to see how the courts ruled.
But as I said, moot point if he won't fight it in court.
