Can you keep any kind of piranha in. 40 gallon? Sorry if it's a dumb question I'm just curious.

Depends on the specie of piranha. Anything baby can be held for a couple months. A 40 gal breeder imo can hold 3 small juvenile red belly piranhas till they reach 3-4".

Generally a piranha needs 15-20 gal per fish and bigger species need more room.

For example my 90 gal has 5 4-6" rbp and they are comfortable now but when they hit 9-12" thats too small. Be aware p's have HUGE bio loads and are pretty advanced fish to keep compared to cichlids and catfish, not to mention the level of aggression p's have toward eachother and those huge razor sharp teeth!!

I love em, ive had many kinds of fish and my shaol is so tight knit, they have eachothers back like a family. I like em so much i sold all my other tanks and stock (gars-eels-shovelnose-ckf-plecos) just so i could focus my spare time/money/energy into their absolute well being and it awesome.

move to legal state, problem solved :) otherwise don't keep illegal fish in illegal state.

back to your question. serra. sanchezi (get to about 6"-7" if remember correctly) would be good in 40g for life, depends on footprint of the tank.
