I bought an FX5 about a month ago on Ebay. It was advertised as new. I had it for a week or two in my tank stand still in the box, never opened the box. I sold it to a member here who basically did the same thing and when he went to set it up found the on the top cover the intake tube is broke off it. I contacted the Ebay seller but doubt he will do anything since he accepts returns for only 3 days. So I will ALWAYS open new items even though I may not use it for a while
 
contact ebay and not the seller, they will set things straight because the item wasnt as listed. file a claim and ebay will make him do it. they have done it for me before.
 
I have contacted the seller and put in a dispute with paypal. So one way or another its going to be made right
 
yeah if the seller doesnt work with you i know ebay will because of that new buyer protection policy or whatever its called, usually the sellers will work with you in fear from not being able to sell and crap like that
 
I've only had a problem once with e-bay, but I filed a complaint with paypal and couldn't be happier with how they handled it and got me a full refund in about a week.
 
Well I'm more concerned with making it right to the person I sold it to. He;s a member here. I feel really bad because I never opened the box and assumed everything was intact since the listing said it was new.
 
Chances are you won't get your money back because it's been 2 weeks.. there is no way of paypal knowing if you broke it or not.

Sucks.
 
Hope it works out. I had the same problem with an item that I only purchased because it was on sale for a great price and it died 6 months later. Well outside the one year warranty.
 
I'm pretty sure I'll get my money one way or another, if not from paypal or ebay then I'll file a claim with my credit card company. So not too worried about it.
