Yes it's a true eel.

Whether or not it can be kept in freshwater depends on what stage of it's life it is in.

No idea about their legality in California

you need to check the regulations from your state's fish and game department. I know here in Florida tons of FW fish are on the "naughty list" (pirahnas, ATF, dorados, FW stingrays)
