Are local laws legally binding to online forums?

  • We are currently upgrading MFK. thanks! -neo
Law governs you as such in a descending order: Constitutional Law -> Federal Statutes -> Federal Regulatory Law -> State Statutes -> State Regulatory Law -> Municipal/Local Law. There are others, but those are the biggies. You must follow all law that applies to where you live, the US, the state, and the municipality. There are some vague areas that apply to things like forums that are internationally held (such as online gambling and such), but this one's based out of the US so it could, in theory, be in jurisdiction of either the place of the server or your own residence.

Granted there are probably no major laws that differentiate the 2.

But what local laws are you talking about? It sounds like your are talking about contracts (legally binding), which isn't local law but K law.

im pretty sure that freedom of speech applies to internet forums

no not really, it has to be on topic and valid to the thread in which one is participating... nor shall it be insulting or rude. :D

Correct. You may want to take a look at my signature - "non-offensive suggestion". Essentially, am I correct to say that I had the right to post that suggestion of mine, provided it was not insulting or offensive?

We would like to think so but sadly the answer is no. There is another fish specific site I was a member of that are set in their fish keeping ways and all the mods pound it into their members. I then found MFK and tried to share info I learned here and they didnt like it so I was banned....

but by the end I probly wasnt nice about since they kept deleting my posts. So when it comes down to it, if you are on a forum you like just go with the flow and let things slide.

I'd like to explain in lay person's language since this is not a forum of legal professionals. Right to freedom of speech and expression is a universally recognized right and one of the most fundamental rights available to us. However, the said right can be regulated although not completely destroyed. Any rule which completely blocks ur right will be unconstitutional. However, your right can be curtailed by means of reasonable regulation.

For instance, u can't tell a teacher in school that what he's saying is rubbish or senseless and if u do a disciplinary action may be taken like detention. Why ? Cause while attending school u are bound by the school's policy, rules, norms, etc. Similarly, while posting in a forum, you are bound by the regultations imposed by them. As long as said regulations are not totally destructive of ur right to freedom of speech, reasonable limits can be imposed. Merely being non-offensive or not rude may not be good enough. Like here on MFK posts are often deleted just to clean up or when people get into heated arguments then threads are closed. All part of MFK's own set of rules.

Aside from whatever law you may wish to cite, internet sites also have a TOS that is agreed to upon becoming a member. Another matter to contemplate is the fact that any material deemed to be inoffensive by one person may be offensive to another person

oh and Yes, right to freedom of speech guaranteed by the American Constitution will be available to you (an American citizen) posting in a forum being hosted on a server in US.
