Bad Weekend - Car Accident

Ok guys...I feel the need to vent:

I got into a nasty car accident on Saturday morning. I think my new Explorer is totalled. I was driving with my parents along a main road and some kid in a Mercury Mountaineer flew out of a sidestreet on the left-side (not stopping at his stop sign) and I had no time to react. I t-boned him right into a small retaining wall and his car rolled twice then stopped when it hit a tree. Mine stopped on top of the retaining wall. I think he looked right past my car not even seeing it...that is if he even looked before going. All I saw was a black streak and all I had time to do was scream and slam the breaks. Everyone is ok...my dad messed up his back and I banged my knee pretty good. Other than that just bumps and bruises. My dad was taken out in an ambulance for his back but was released with some pain meds. I stayed at the accident but went to the ER after to have my knee looked at. Just a really nasty contusion. The cops gave the kid a ticket and said that he's 100% at fault...I just hope the insurance companies see it that way when they get the police report. I wasn't speeding because it's a bad intersection to begin with and there aren't even any skid marks anywhere on the road. The airbags in my car didn't even go (oddly enough which is a question in and of itself because we were going like 35mph when we hit). The airbags didn't even go in his car.

All I can see every time I close my eyes is the picture of that car rolling in front of me. I thought when you see cars flying around in the movies it really is just that...the movies. But man this car flew. I couldn't believe it. That kid is lucky as hell that he walked away without even a scratch. He had to climb out his passenger-side window.

I wish I had thought of taking pictures with my cell phone but I was in complete shock the whole time while all the cops, firemen, and emt's were crawling around. It was all I could do to just answer their questions. I went to see the cars at the body shop they were towed to this morning to take pictures of the damage but they had already taken my car inside. His car is a mess. I can't believe how much damage my car did...it left a complete hole in the passenger side of his car. I've never gotten into an accident before so I hope this goes smoothly. I called my insurance company and got everything all open for them to go after the kid's parent's insurance.

The one thing that really got me during this whole thing...no one apologized...not the kid nor his parents. He could have killed someone because he was in a hurry and didn't feel the need to stop at a stop sign.
 
Glad you and parents survived the crash Mel. Running stop signs seems be a deadly bad habit amongst aggressive drivers.

A couple things I would like to comment about your accident.

The Explorer and Mountaineer are both Ford products. I would look into why the airbags didn't engage. If they did, your father and you may have received less injury.

The fact that the parents or the kid didn't take any responsibility or offer any apology tells me that the lack of civility grows high in this family. This is problem that the current last two generations have developed as being the almost norm. It's said that there are too many people that can't take the time to recognize their own mistakes and the hardship they bring to others.

Because I do so much driving, I have told my wife many times, that she will lose me in an auto accident. I have had so many close calls, I can't even remember them all. I am the number one defensive driver on the road. It's so bad that when a car pulls up to a stop sign too fast at an intersection, my automatic reaction is to start swerving away from it. The worst in my opinion is all the distracted drivers that cross the center line on narrow roads. The biggest culprits are the full size pick-up truck drivers.

Hope your knee is okay and your dad's back doesn't turn into a long term chronic problem.
 
I'm very sorry to hear your news, Mel. I hope you and your father make quick and full recoveries. I'm glad, for your sake, that the other driver was not hurt - it would only have made you feel worse in the long run.
I trust the insurance companies will do the decent thing for you all.
I hope you can take it easy for the next few days.

Glad everyone is ok. Cars can be replaced.

I have seen many bad accidents. Have seen a RV, a Ford Explorer and an Ambulance roll over (the paramedic in the rear of the Ambulance was killed, driver fell asleep). Have also seen 2 bad motorcycle accidents. I have also seen an airplane that landed on a highway (did not actually see it land, but it was still there when I went to work).

I finally got word from my insurance with regard my crash (about 6months ago now..) and the other insurance has finally admitted liability, and will be paying costs. however I did end up with whiplash as a result

somewhat similar to your accident, except in this case the tractor didn't make it out onto the road. I came around the corner with oncoming lorries the one side, and then the tractor driver (with NO visibility whatsoever) pulled out on me. and same as you, it took me a while to think about getting photos, did get them, however the tractor driver had removed his vehicle prior to me thinking of it.

I'm still waiting to hear if my car is totalled or not. The at fault insurance company STILL has yet to hear from the driver of the other car to get a statement. Unbelievable. I can't wait to see the police report. Only problem is now my company is going to pay my claim and subrogate, so I'm out my deductible til they get it back. I also have to wait to get my medical bills and rental paid for.
 
I don't think so, it needs a new front axle. You can see something wrong there in that wheel well.

Ok...so I'm gonna vent again.

I got the police report. Of course, the kid tried to lie. He claimed it happened like this....he stopped at the stop sign and was edging out when I flew around the bend and creamed him. Well, the witness that saw everything said yeah no...he didn't stop and I wasn't flying. I had just pulled out of a store right around the bend...I hadn't even reached the speed limit yet (which was 40mph). So he got caught in the lie. He also said he was going to turn left and not go straight across to the deli...I don't see how that's possible when you look at where I hit his car. If he was turning left I would have hit him in the back end. Anyways, he got a ticket for running the stop sign and was held fully at fault.

Now, the responsible insurance company STILL has yet to talk to the other driver. They told me straight up after seeing the police report that they will accept liability when they talk to him, but they can't pay anything out til they do. Some legal thing they said. They sent an appraiser to look at it. They put the value at $12,050 and visible damage at $7,822. They said it's a borderline total loss. They also said that it needs to be ripped down to the frame to see if there is any other damage that the appraiser couldn't see visibly...and that most likely there will be. So then if they do find more damage it could very well be total loss. And they estimate that it will take 12 days to repair.

I'm just so upset. If it doesn't get totalled, I'll be stuck driving this thing for another 5 years. I've only had it for 4 fricken months. I think it's a little unfair that I get stuck with a car that's had that much damage and will never be the same. It won't be worth the same and there's no way it will last as long as one that hasn't been damaged like that. All because of a stupid kid that can't drive or own up to his own actions. I hope they find more damage because I really hope it's totalled. I have a new car all lined up with financing ready to go. The salesman has helped me out a lot calling the repair shop and whatnot. If I am stuck with getting the car fixed I've already decided that I want the Ford dealership that I bought it from to fix it. They have treated me so well with fixing my old '96 Explorer and with the sale of this one that I want to continue giving them business. Plus, chances are they'll have a master mechanic working on it and it will be all done by Ford specialists.

Now my insurance company is going to send out an appraiser tomorrow so I'll hear what they have to say then. I just hope to the gods that they total it. I wish I could track this kid down and tie his ear to the phone. His parents are just as irresponsible as he is for not making him call.
 
I hope it gets sorted soon for you, it's never a nice thing and the time frame only prolongs the frustration. All I can say is don't let it get you worked up any more, it will be dealt with and putting yourself through additional stress is really unnecessary and counter-productive for your recovery. I remember when I had a head on collision it stayed with me for a long time and it was a drawn out process (as always with insurance), you have a witness, it is more than your word against his, you have ammunition and they know it. The process will be resolved, it will always be a lengthy one though, that's just how it works.

Before you know it you'll be back on the road, the sooner you can relax and let it go the quicker that time will pass, trust me. It's not your job to worry about this any more, it's the insurance and your law enforcement agencies problem, that car will be a write off IMO. They'd rather strip it for parts to cover some expense and fix you up with a new one, of course if they write it off you can try get them to let you keep it, strip it down yourself and you're left with a bunch of spares, that's what I did.
