Being held responsible for forum posts...scubaboard.com lawsuit

There is an ongoing suit against the site scubaboard. I found this interesting/ridiculous. Wonder if the plaintiff actually won and some sort of precedent would be set forth...probably opening the door for millions of lawsuits.

Here's my understanding, based on a quick reading.

There was an accident at an overseas dive op that involved bad air and diver deaths. Word gets out, and news hits the forums. Dive op is upset about some of the bad things said about them. They sue Scubaboard, one particular person, and 100 John Does (forum members who said bad things but they can't identify).

The guy who is mad wants:
(1) SB to take down everything that was said about him and his dive op
(2) SB to turn over the names and identities of anyone who said anything bad about him
(3) Ten Million Dollars
(4) A jury trial

Thoughts?
 
1. Internet is public information
2. Giving the names invades personal rights to privacy

I wish I was a judge.

" I hereby grant you requests 1-4, provided you return the lives of those who were lost. Should you fail to return said lives...you will be sentenced to 10 years in prison and not be granted your requests."

Stuff like this is sad...because no-one can ever afford to fight for what is really correct, settlements happen which shouldn't, websites come down, and people lose everything. All because somebody who did something is mad because somebody said they did it.

1. if they take down the site they interfere with the right of freedom of speech
2. unless the people who said the remarks agreed to let the site give out their name its illegal for them to say who it was
3. they shouldnt pay anything since it wasnt the site that said it they only hosted it

agreed, there have been alot of lawsuits of where a intruder broke into someones house and hurt themselves on something (i.e. they tried to break a window and cut their arm) and they sued the family who lived there and won hundreds of thousands of dollars

Sounds fair. I think that even if you end up being responsible for the death of some happy vacationers you should not be denied your inalienable right to find a silver lining that leads you to an early retiremen. Kudos to free speech that granted him his gravy ticket.
