It's a currently empty rimless that I plan to make into a planted (and start dosing co2 and excel) just wondering so I don't end up indirectly killing my cat.

My cats and my dog drinks from my tank that sits beside the stairs....they've been doing it for a while now.

I'd be just as concerned about my fish as my dog/cat.
About them getting eaten?...my dog and cats don't show much interest in eating them...probably because they seem to be too fast and too far down for them to catch.

My dog used to perch at the edge of my pond and snatch marigold swordtails out, not to eat, just to play with. I usually could return fish back unharmed surprisingly. Luckily she grew out of that habit on her own, lost interest.

My cat would drink out of tank, no problems.

My cats used to drink out of my tanks, it never hurt them. My girl (cat) even used to swim in them, that's when I decided to get hoods for them all. Haha

Whatever you do, don't use Pothos plants. The roots are poisonous to dogs and cats. I wouldn't take the risk of the cat nibbling on the roots in the water. (may not be likely but not worth the chance)

I had a cat years ago that accidentaly took a swim in one of my tanks. I had some cheap thin glass as a top(fish room, young guy, cheap) and the cat broke the glass and was so pissed. It was really funny, cat shot out of the tank and my fishroom like a rocket. Couldn't find him for about 4 hours.
