Congo maybe Nile Bichir with back half acting paralyzed at LFS

I was at LFS in the southern part of my state today, and they had what I think was (2) 12" Congo or Nile Bichir labeled for sale as a "Dragon Fish" for $40 (seemed like a steal to me), however one had committed suicide by being stuck in a filter intake with no screen. I know it wasn't a Senegal or Ornate Bichir (these I am quite familar with). I left the LFS owner aware of incidence, and thought for sure I would buy the other one.

However, I was to skeptical to make the purchase as its back half kept lying flaccid and flipped left as if it was partially paralyzed. When it was swimming it seemed to straighten up some, but every time if it sat at the bottom the tank the back half of its body appeared in the same condition. Is this a common ailment for bichirs, nothing out of the ordinary, or is it from being poisoned by ammonia or nitrite? Is this easily fixed? Needless to say, I guessed the latter and deemed it to risky to purchase even if is a rarer bichir, did I do right here?
 
this looks like the fish both in appearance and the way its back half lies (however the one at the LFS seemed considerably worse)

never heard of anything like that but not a pro lets see what we can find out on here
 
The fish is a Congicus, not that rare, and IMO not nearly rare enough to spend money on if it isn't in top shape.

My opinion - avoid.

I agree its a Polypterus endlicheri congicus, dont ever get something that is not in top shape from LFS, thats the benefit of buying from LFS you are sure of the physical condition of what you are buying, as against buying online.

as a rule get the most active, physically attractive, and with attractive patterns to your taste, when buying.

- note i say "
your taste" as some like the standard look of a species, and some like the unique once that diverge from the normal.

IMHO also in Japan nothing is rare, they have the best specimens and as far as i know the most advance in bichir keeping, so rare is relative to where you live
