OREGON, Wis. (Feb. 18) - A father allegedly shot his 9-year-old son in the buttocks with a BB gun :eek:, a revelation that came to light after the boy wrote a school essay about the incident. The boy had written an essay about the "painful afternoon my Dad shot me with a BB gun :(." The elementary-school teacher turned the essay over to authorities.

Prosecutors charged the 36-year-old father on Friday with one felony count of child abuse. The charge carries a maximum penalty of 6 years in prison and a $10,000 fine :WHOA:.
The criminal complaint said the father told an investigator he shot the boy after the child didn't move fast enough from blocking the TV. He said he aimed at his son's rear pocket because he thought it would be more padded :screwy:.
"I knew right away it was a stupid thing I did," the father said. "I told my kids the only way I'm going to touch them is to kiss them, hug them, tickle them. I was very, I was not under the influence of anything. It was a very stupid decision."
He was released Friday on a signature bond and ordered not to threaten or engage in any acts of violence against his son. He was also ordered not to engage in physical discipline of any child.
 
Dumb, but shouldn't be a felony.
I've been shot with bb guns before and they don't hurt that bad.

Two words: capital punishment.

Who shoots children with BB guns?

Let's say someone empties a few clips out of an AK-47 into the sofa that you're sitting on. You don't get touched - not even grazed - by a bullet. You'd still want to be able to press charges of criminal assault, no? Pain makes a terrible yardstick by which to measure the severity of a crime.

Pretty sure the case will be thrown out, all the kid has to do is tell the judge that his dad was playing around.

Actus reus. Mens rea.

Playing around removes the mens rea, but not the actus reus. Keep us updates. The charges will stick, but odds are they'll work out a plea deal.

Plea deal for shooting your son in the buttox with a round of bb? He's 9 years old, sheesh when I was 9 I took a paintball on the chest lol
 
hmm maybe his dad was just playing around...but you have to understand why they took it so seriously though. loads of kids get abused these days and then its too late to do anything about it until they find a body :( there was one in the news a couple of days ago about a baby being beaten to death and the council knew about it but didnt do anything about it.

Courts tend to take child abuse seriously.
 
Felony count for a bb gun shot? Seriously? My grandmother spanking me one the butt when I was 9 hurt more than that....

People here the word gun and get all worked up...
 
Someone will protest and he will have to serve some sort of time. While I agree the guy is an idiot, lets not get carried away with the word "abuse" it was a BB not a buckshot.
