Please hang in there with me I know this might turn out to be quite lengthy but I really need your guys help/advise here.I find the MFK lounge the place to get some of the best advise around.
So awhile back I got my xbox elite stolen,but I still had another regular one that was being repaired for the ring of death thing.I send in the xbox to get repaired.It does and they send it back my way and give me a tracking number to follow it.I'm tracking it and it gets stuck in Texas somewhere for like three days on like April 1st.I stop tracking it because the "expected delivery date" says it wont be arriving until the 7th anyway.
Fast forward to the 6th and I look on the tracking page again and lo and behold!It says that the package was already delivered to my house and was signed for.I was home at the very minute it says the package was delivered and nobody even knocked on the door.The person who tried to sign for it didn't even give a signature just a scribble line.In the space where it says "signed by" the name is TBUCK ,my first initial and part of my last name.In the past when Ive signed for things it has said my whole first and last name.
So I give Fedex a call and they say I can file a claim.They send me the papers and I start filing the claim and I see right there on the papers that as the receiver I am not the one who should be filing the claim as Fedex deals with those matters with the shipper.
Meanwhile I got to my local fedex office and give them my real sig,and I never hear any sort of follow up on that just a return call saying they cant help me and I should call the 800 number who told me to go find them in the first place.
I call fedex back and now they confirm that yes,Microsoft is the one who has to file the claim.
I give Microsoft a call and tell them whats going on.They get back to me a few days later and let me know that they will not be filing a claim due to the circumstances (the fact that it was signed for by someone other than myself and not lost or broken in the shipping process).
I inform Fedex that Microsoft refuses to file a claim.They say thats fine but if thats the case they "will still need written and signed authorization from the shipper indicating their waiver of the right to pursue a claim".
I get back in touch with Microsoft, and they tell me they will not be sending me a written or signed anything and that fedex can use the reference number from my case to get all the info they need.
Fedex says they are crazy and thats not how it works,and that they have never in their past dealings with Microsoft done it that way.They insist again that they need a letter of some sort sent to me so I can send their way or sent to them directly.
Now I am being used as a middle man for the two parties to argue over this matter,and have gone back and forth between the two maybe 4-5 times with the same message.
What it comes down to is the courier forged (or tried to anyway) my sig and took the package,forged my sig and left the package at my door (which would be stupid as I live in an apartment complex),or let someone else sign for it who had no proof they were me nor had they even come out of my house.
What do I do?I have 28 days from the delivery date to take care of this and they are just jerking me around letting the time run out.

and to add to that a certified letter threatening legal action against the company never hurts either.. Plus get some of their higher up's e-mail addresses and start blowing them up with your complaints too.. eventualy someone should give you a hand even if it's just to get you off their back..
