"A 74-year-old East Naples man is behind bars after authorities say he threatened two law enforcement officers who caught him with an undersized fish, and struggled with one of them.
Jose M. Baez, 5259 Confederate Drive, was charged with battery on a law enforcement officer, resisting an officer with violence, and violating a fish and wildlife statute.
Just before 6 p.m. on Thursday, a Florida Fish and Wildlife Conservation Commission officer found Baez fishing just north of the Judge S.S. Jolley Bridge, according to an arrest report. The officer looked in Baez’s bait bucket, and saw an undersized Gray Snapper, reports said.
When the officer asked to see inside the bucket, Baez attempted to throw the snapper into the water. The officer told Baez to put the bucket down, but he didn’t, officers say. Baez and the officer then began struggling for control of the bucket.
After gaining control of the bucket, the officer told Baez three times to turn around and put his hands behind his back, reports said.
Baez got into a fighting stance, and then shouted "Just put a bullet in my head," according to reports.
The officer pepper sprayed Baez, and ordered him to his knees, but he didn’t comply. When the pepper spray wore off, Baez grabbed two large rocks and again assumed a fighting stance, the commission reported.
Baez continued to tell the officer to shoot him in the head.
A second officer arrived on the scene, and Baez threatened him with a rock as well, according to reports. Baez was arrested after Marco Island police and Collier County sheriff’s deputies also arrived on scene."
