I posted this in the Save the Asian Aro Sticky but dont know if anyone is really reading it and I do appologize if this has been brought up already but here it is again would love to get some of your input on this !

The Part I want to really share is this

Loans and Gifts. Lawfully taken and
held endangered and threatened species
may be shipped interstate as a bona fide
gift or loan if there is no barter, credit,
other form of compensation, or intent to
profit or gain. A standard breeding loan,
where no money or other consideration
changes hands but some offspring are
returned to the lender of a breeding
animal, is not considered a commercial
activity and, thus, is not prohibited by
the Act and does not require a permit.
Documentation of such an activity
should accompany shipment.

If it is illegal then why state that if an endangered species is ok to bring in if proper paper work stating that there is no moneys transferred and was passed as a gift is OK?:screwy:

Thats your answer ? Then Why does it state that for? Im not looking for simple answers give me a real justified reply please it states that right on their website of laws etc.

"These fish may not be imported for commercial or personal pet purposes"
http://www.fws.gov/permits/faqs/FaqB.html
you can only keep them if you are a scientist doing research under the support of government!

Thanks for that thats the link that led me to the gift/loan paragraph , again it is very shady and not understanding

understood but it does not state that in that paragraph it clearly states then it is ok, whos to say once its in your possession that your not going to keep it as a pet? this is very unclear but again more like a lot of red tape and BS IMO

that section refers to the fact you have a permit to possess an asian arowana. In order to lawfully possess one you must have a permit.

"What Activities Are Prohibited?
Without a permit, it is unlawful to
import or export; deliver, receive, carry,
transport, or ship in interstate or foreign
commerce in the course of a commercial
activity; sell or offer for sale in
interstate or foreign commerce"

The rest;
A standard breeding loan,
where no money or other consideration
changes hands but some offspring are
returned to the lender of a breeding
animal, is not considered a commercial
activity and, thus, is not prohibited by
the Act and does not require a permit.

Refers to the fact that you have a correct permit and are attempting to lawfully breed the fish you dont need a permit to loan a fish to another permit holder, for reasons other then for commercial gain.

I dont see how your confused about that, they are clearly illegal to possess unless you are a permit holding scientist or biologist

I think the whole thing is just ridiculous honestly they also state that a lot of the farms are just producing hybrids well then if a hybrid is being produced and they cannot put these back into the wild then these with the proper paper work should be allowed just like any other species
