http://www.planetcatfish.com/common/species.php?species_id=134 Heteropneustes fossilis aka Fossil Catfish, Liver Catfish, Scorpion Catfish, Stinging Catfish has a small defined dorsal for one. So this is not it. Looks like a walking catfish to me - a Clarias, most likely http://www.planetcatfish.com/common/species.php?species_id=90

Whatever it is, ALL Clariidae - http://www.planetcatfish.com/common/family.php?family_id=6 - are VERY illegal in FL and all of the US. Your LFS would be fined big time or closed down if caught selling them. You too for buying it (you cannot get a permit for it if you are just a hobbyist). But it is nearly unenforceable.

Be very careful, please. MFK strongly condemns all illegal activity.

Thanks for the heads up I was talking to my girl about it last night and were definitely gonna get rid of both of them. It was sold to us as a paddle tail catfish and I really don't think the guys at the lfs had any idea they are pretty stand up about this kind of stuff. But when I go back I'll be sure to let them know. Thanks again guys for all the help.

The legal measure for "getting rid of them" is to kill them, per my links above, sadly but honestly. They are "kill on sight" fish in FL and the US.
