I am planning to stain the outside of my pond and the top lip around it where it overhangs. Is there a fish safe stain that i can get? Or do i even need to worry about it since it will not be touching the water?

You have to worry some.
If water runs off the stained area into the pond it will effect the water quality and in turn hurt the fish.
If the stain is a waterproof stain after it's dry (cured?) you should be good to go.
Make sure it's a non-chalking stain too.
