ONE, the implications of the sony V. George Hotz "ps3 hacker" would allow anyone cracking there system to be considered illegal again.
If anti-circumvention laws were applied to things like cars, for example, if the screew on the oil pan was proprietary it would be illegal to change your oil.
TWO, (i should have posted this last month but i forgot)...for anyone using a jailbroken device to use the tethering ability...
STOP, holy jebuus. The headers sent out from a tethering device are different then just what your phone would send out. Thus, your ISP can see your tethering with out paying and will charge you extra.
TWOa) yes they can change you extra, because you broke TOS
TWOb) no its not illegal for them to spy on you, DPI is legal on mobile connections because the FCC is dumb.
Twoc) yes they can track you, even if you be super sneeky and use a VPN or Proxy
