Legality of selling Windelov Java Ferns

I've been wanting to try propagating and selling aquatic plants. Reading that java ferns were an easy plant to start with I impulsively bought some Windelov java ferns. Upon getting home I did a little research and found some sites that say it is a patented cultivar. http://www.aquahobby.com/garden/e_windelov.php

I would rather have normal java ferns, but since I already have these am I likely to get in trouble for selling any? I see people selling them on aquabid, ebay, and even here. Or should I just play it safe and get rid of them so I have more space for non patented plants? Either way I might still keep some for fun.

After about 3 weeks I'm getting plantlets growing from rhizomes and one of the leaves btw. The older leaves don't look as great as most pictures I see, so I might have to adjust some things. The adult leaves are green but have some dark areas. They are currently in a betta aquarium. They aren't attached to anything yet. I've been trying to waterlog a small branch but it is taking forever. It is now barely floating, but still not there yet.
 
Also I have some hornwort and duckweed that the LFS were not able to identify. If I would like to potentially sell, would I be better off getting rid of these and buying specific species? I see some people selling these without specifying the species.
 
I have the same specie of java fern, and was going to propagate them to sell. That sucks if you can't sell or even trade. Just checked Aquabid and they do specify of having a special permit to sale certain species of aquatic plants.
 
I personally would want to know what the plant was I was purchasing without having to guess what it was.
Btw went to a Cichlid Convention in my city, and people were selling all types of aquatic plants.

Thanks for your opinion and I agree. I bought on impulse. Also I wasn't sure I was ever going to try to sell and wanted some plants to help with my betta tank(considering it is a 5 gal I probably have it crowded in there.) I have the duckweed in some jars, while I decide what to do, because I figured it would be a pain to get out of an aquarium. Luckily these are cheap plants to replace and I didn't get many.
 
I wouldn't worry too much about it. It would be one thing if you opened a Petstore and were selling $500 of it a day. If you're selling it locally to friends and other hobbyists you'll be fine.
