I don't think that's a Garter snake.

Thats the one thing that has that shape of a head and design and is native to VA

Garter snakes vary in color and pattern from location to location. The ones here are pretty much black with some green, yellow, and a little red. He looks very thick for a garter snake though.

Looks more like a king snake or a milk / corn snake.

I'm almost positive it's a Northern Brown Snake, Storeria dekayi dekayi. This species is closely related to Garter Snakes. They max out at about 13-15 inches.

Has not been released thinking about keeping it but have to see it eat to make it offical
