Making a sump

1/3 of the tank size is what I've read, so make it a 13 gallon instead. :ROFL:

I'm sure it will be fine, but who am I to say?
 
If your bio-load isn't to high you can make an efficient one out of it, just keep a lot of bio-material in it with good flow.

if you use pvc pipe for the outflow (back into the tank) drill a hole just below the waterline on the pipe so if the pump goes out and water starts to siphon back down into the sump, the siphon will be broken when the water level reaches the hole. make sure you have enough extra room in the sump for the few gallons that will backflow.
 
you can use a 40g sump for a 10g tank! go for it. just make sure you do the power outage test. The hole in the return line is a must. (like stated above)
