There is a thread up that needs to be addressed by a mod or somebody ASAP! I am posting this thread cause the other thread was somewhat mislabled IMO and to draw more attention to this theif and unfair situation! Basically: a member on here was getting a free 360 gallon and posted on here about it. And then some other (unconfirmed who as of now...) member texted the person selling the 360 gallon pretending to be the member who was getting it! Identity theft! Fraud! And he said "I'm just texting from my friends phone" and he picks up the tank. This is UNFAIR. I feel so bad for the poor guy... LINK TO THREAD:

Although I am not a lawyer, this sounds like fraud, not theft, and regardless is a police matter. Since nothing was actually sold, it may depend on the person giving it away to file a report. Identity theft also has components that might not be applicable as well depending on how the tank was offered, how the phone was used and how he actually represented himself in the text.

Longer it takes to report, the less likely to get resolved.
 
It's morally wrong but I'm not sure it's a police matter?
 
I don't see them getting involved since no money was lost but it would be interesting to see how they view this.

Read the other thread... The theif is a complete idiot... I think He already had a 360 but was only 2 foot wide and is gonna use the new "stolen" 3 foot wide becausehe offered to sell a 360 to David for $1800. If david said yes this idiot would probably give his adress away!

To me it sounds like wire fraud (assuming texted messages are covered under wire fraud) or mail fraud if that's where texts fall. If a person intentionally provides pretenses to obtain something of value. The part that is unclear to me is 1) are free things covered 2) are texts covered 3) how exactly was it offered and how exactly did he communicate with the "seller"

I just don't know if the seller can be defrauded for something he was giving away and if it depends on how it was being offered.
