My FH swimms around and sinks

I bought this guy from petzonesd.com he swims around but sinks afterwards. Sometimes he falls on his size hes breathing and everything but idk why he does that. When he arrived there was no water in the bag so i rushed him into the tank. Idk if its a blatter problem or what!? I called the shop showed them a video and i was told he would be fine he must be tired. They assured me if he died i can get my money back. But i want to kno what could it be? Thanks!

What do you mean no water In the bag? Do you mean that there was a little water or no water at all. How long was it like this before you got it. No matter what, I don't think that the flowerhorn will recover. I hate to say this but I hope it will die and you get your money back. There's no way that you got the fish with no water and that it's tired. How long did they give you to get a refund if the fish dies? I'm just asking because the fish can still be alive for awhile and it will be too late to get a refund
