Need Serious Legal Help!!!!

I have worked for this restuarant starting at the beginning of the summer up until 2 days ago. Basically I had a family emergency one day, (the day after i put my two weeks in) and I was supposed to come into work at 6pm and close the restaurant, but i came in at 1pm and gave them a 5 hour notice I could not come in today. Now, I am not on the schedule anymore so I am pretty sure they just let me go. I have tried talking to the manager twice but both times she said she was on the phone then put a note on her office door saying DO NOT DISTURB ON THE PHONE. They have a history of not paying their employees and I am worried they are going to give me the run around and try not pay me. I need to know what course of action to take..... Please anyone some advice is really needed they owe me bout $1000.


Oh and by the way, I have proof that I have worked all those hours because I kept my time stubs and have a log of my hours worked.
 
Employment laws vary state by state. Here in California, we are an "at will" state which means that either party (employer/employee) can terminate employment at will. If you live in such a state there isnt much you can do. You might be able to work the "I got laid off before my final day" if they took you off the schedule.
 
its not that i care that i am not working anymore. But what I do care about is my money. They owe me and old pay check along with the one I should have gotten before they fired me. Legally i HAVE PROOF for the time i worked so they have to pay me. But how do i get them to???

i would start by telling them if they dont pay you, you will settle it in small claims courts.
as for how you get them there if they refuse, i dont know. but i dont think it will be too hard
 
When is your scheduled payday? You can't do anything if that day has not passed yet. You said that you are worried that they aren't going to pay you, that is why I ask.
 
You will get more help in the lounge area... However since you kept your time stubs and logged your hours you will be fine. Small claims court may be the best way to go if its even necessary.
 
Not up on employee law, however i know here that family emergency's consist of emidiate family, Mother/father/husband and wife only,
Which a few people in my work had problems when children went into hospital so naturally they took off the time, however they had no leg to stand on, which i think is so 1900's
 
you will be paid, if not find out what type of "labor board" your state has............calm down, you do not need legal help, you need patience.
 
b-4 you consider a lawyer or go to small claims court (always an option but will it be worth it with a lawyer?), go to the dept of labor (in NY we are also employment "at will" state) for some guidance & maybe lodge a complaint. now if you really want to stir up matters, ask other employees if they have similar issues......

if you do need an attny, try CL & see if anyone will take your case on a contingency basis.
