Passing Gas = Battery???

SOUTH CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.

Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.
Then, he failed sobriety tests and was arrested.
When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.
Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

Dude did that in my High School....no lie.

He used to fart on people when they were sitting. Then he thought it would be funny to take it to the next level. He pulled down his pants and boxers, and tried to let it go. Pushed too hard, and he left more then a fart.


He got expelled :(
 
Battery is defined as the

"Actual intentional striking of someone, with intent to harm, or in a "rude and insolent manner" even if the injury is slight. Often coupled with Assault (that does not require physical touching) and most often pair together under Assault and Battery."

This is absurd, are they arguing the particulate poo matter floated across and "hit" the officer's nose? In the legal world you can't argue battery, whether it's on a police officer or it's on jesus himself unless there is TOUCHING. It didn't say "suspect scooted over and gave the officer the old stinkface". Grouchy officer can't take a joke.
