Kind of an odd question but is it permissible to keep any kind of Penguin as a pet in the USA or Canada?

I have been unable to find any federal laws on penguins. I also have been searching for any species(esp jackass penguin) to buy and can not.
 
It seems that most penguin species are considered to be threatened or endangered species. There are several species not listed that may be allowed to be kept as pets. I have no idea what is required to obtain them.

Take a trip and catch a pair breed them and make a killing. There's no law so they can't fine you. Right?

Jackass penguins are endangered so sadly I cant. They would be perfect as they like warmer temps then most of the other penguins.
 
They aren't called that anymore. They are known as African or African Black foots.

The problem isn't the laws here to have them, most are protected in their native areas. I know when we got Fairy Blues several years ago, there was a paperwork nightmare in order to get them.

Also consider what you are jumping into. Only 5 species are warm water penguins. You'll need a colony - not just one or two - in order to keep them healthy. You're looking at a pool in the 20,000-30,000 gallon range, and a monthly food budget that would feed a small family. Penguins also tend to have sensative respiratory systems - so expect a very large air filtration unit to keep them healthy.
