He can just pour 1 gallon of milk into either jug doesn't matter..because they're both empty to start with.. ?

heres' another one, though haynchinook may know it

there's a bucket of apples, a bucket of oranges and a bucket of apples mixed with oranges. you can't see through the closed buckets and they are each labeled. one says "apples", one says "oranges" and one says "mixed". each bucket is labeled incorrectly. how do you put the right label on the right bucket? you can only choose one bucket to take out one fruit to see what it is.

no. fill up the 3 gal, pour it into the 5 gal so now the 5 gal has 3 gal of milk in it. now fill up the 3 gal again, and using the full 3 gal of milk, pour that into the 5 gal until it fills up. it will take 2 gal away from the 3 gal full of milk to fill up the 5 gal. you now have exactly 1 gal left in the 3 gal jug
 
Ah gotcha. I would just fill it up with a gallon.. although I suppose there's no measurment lines on the gallon buckets.

yea, he failed to mention there's no measurement lines or measuring device or that you have a cow you sqeeze milk out of so there's no way of knowing how to get 1 gallon only using the 3 gal and 5 gal jugs

to me, that's what makes a good riddle. you have to give all the details and eliminate all other possibilities of other answers and limit the riddle to having only one true answer
 
I agree, although it is hard to think of every possible scenario that the human mind can think of, but I really do like these riddles in the morning, gets your brain working!
