Can Us W.Fish. service go to your home if you have illigal fish like Asian Aros or chanas,do they have to get a court order or just go there and take it , can they arrested you or just give a fine
 
That I know of, this was pointed out to me by a "fish hawk" in Washington, they need a warrant to enter a private residence but like police can enter private property if a criminal act is being committed in plain view. To get a warrant all they need is "a report from a known reliable source" in other words a confidential informant. To get a "no knock warrant" they have higher standards. They can and do tend to remove all fish and tanks from a place if there is any question of legality so if they find a single tank containing a banned fish they are likely to confiscate every thing for "evaluation" so even if they return the tanks and equipment the fish are usually dead by then and since it was a "good faith" seizure you get no compensation unless you can prove in court that they knowingly and maliciously exceeded the warrant, not easy to do. They do have the right to arrest and jail you and the courts tend to follow their suggestions as to where to set your fines. They can also screw you up in other ways if you piss them off by tieing prohibitions to owning tanks to your probation or deferred sentence, refering any smuggling involvement to customs or "homeland security" agencies, or even refering you for audit by the IRS if you were involved in any commercial transfers.
 
hmm.. I was told by an attorney that US F&W does NOT require a warrant to enter your residence. The various STATE agencies (like CA DEPT of F&G) do require warrants . Either way though, as guppy rightly points out, getting the warrant is not difficult... all they have to do is suspect you of keeping illegal fish. Keeping fish which are federally banned (like Asian arrows or some others) is pretty damn serious.... you are playing with fire. Read guppy's post carefully... no messin around.

the illicit trade in endangered animals (and animal parts) is serious, and govt's really are cracking down. Its good. The enforcement is good... its just too bad that something like Asia arrow which really SHOULD be legal in US (as they are elsehwere ) with proper Cites paperwork. That is just stupid. But overall, the strict enforcement is good.
 
aside from tracking the sale of the fish how on gods green earth would any of the above agencies EVER find out what type of fish one was keeping in there tank in the privacy of there own home. just curious on how they operate and what are their methods of investigation are...

I dont live in states , just want to no, so is that bad :( .
glad dont have that in here. if i have any illegal animals they must ask to enter in my home, is like speading in a car you just get a fine and is not that bad,
the courts dont give warrant to enter a home because animals,but is getting worst now , if i want a reticulada snake must go to spain and buy ,we are the only country in EU that is illegal to have piton snakes ,boas,etc :swear: ,
but is worst if you have wildlife animals.
but can have chanas and asian aros :D
