Western Mosquitofish is illegal in Minnesota

It's official, Western Mosquitofish (Gambusia affinis) is prohibited in Minnesota.
 
...because they're invasive? I'm asking this seriously.

Don't lots of states intentionally stock these to control mosquitos? Or is that another gambusia sp?
 
Would they survive MN winters? I mean they are hardy but those winters you have are cold!
 
They used to stock these mosquitofish for biological control for mosquitos but it has proven that Western Mosquitofish cannot survive the Minnesota winters. Last time they stocked mosquitofish was back in 1960s and no populations has found in MN. There is a strain that can survive the winters but they are limited in numbers and nobody in MN use them for mosquito control. I think it's flawed since you can find mosquitofish at the lfs easily.
