What can one do when 45 day past to claim refund with paypal?

HI guys:

Was wondering what my options is to get my money back from a purchase that I paid thru paypal due to "circumstances" the fish shipping delays happened and now its the past 45 day mark for paypal and I can't do diddly squat with getting my money back. One downside to fish not being living beings is that sometimes those things really do take longer than 45 days. :irked: at paypal.

The guy owns the website, and have not answered the phone calls I have made, have not answered any emails just have seemed to disappared. Others having same issues I was wondering if it was possible to take someone to court over 181 bucks? If I live in the state of IL and teh guy lives in the state of PA? I also was wondering about using a one time thing with collections agency if that was another possiblity too even if they willing to do that?

181 bucks means a whole alot to me, it means a nice school of jaguar catfish, it means a nice collection of higher quality driftwood I can have in the tank, it means just so many things that fate has screwed me over.
 
paypal has a certain amount of days you can claim.you blew that. call your bank & say it was a charge you did not approve.

im guessing you didnt use a credit card....

did you order the fish and they died after 45 days later?
 
if your circumstances are severe enough to warrant you going over 45 days then i would contact them and explain the situation, anything short of a death or hospital stay and i doubt it but you dont get if you dont ask. they may give you another course of action or approve the refund seeing as you have taken reasonable steps to contact the guy.

that's what i'm wondering. If this is the case you're SOL no fish place in the world will give you 45 days. but if this is not the case please give more details.

I ordered a couple of strendker discus.... never got them in the first place due to the guy not shipping them out due to "circumstances'

No, the guy kept saying that someone fed the discus so they couldn't be shipped out
then there was a death in his family

(keep in mind that: he has a good rep with discus community) so I didn't care or mind

then I went on vacation I expected to have the fish before I went on vacation, so we agreed to hold the fish til aug 1st, when I get back lo and behold-

he gets attacked by africanized honey bees-

since no word, nothing I started to panic after reading a flamming post from another member on a certain forum and what made me nervous was that it was not even living specimen - no reason to delay shipping at all..... and we placed our orders similiar time....


eh too tired to even try anymore though I'm trying to get ahold of paypal right now to get EXACT name and information so I can see if I can pursue it thru the court.

tell them about his reputation which you trusted and thought it was just some bad luck with the order. then after all reasonable attempts to contact him he stopped replying to you so you decided to try and get your money back. explain it to them, they will probably investigate.

i asked the virtual agent "its past the 45 days and i still havent recieved my item".

we then went back and forth a little and it said to open a dispute and the last paragraph was:

"You initially have 45 days after the date of the transaction to open a dispute, based on not receiving an item, or receiving an item that is Significantly Not As Described. The dispute can be escalated to a claim by either party up to 20 days after the dispute was filed, at which point PayPal will investigate the claim and decide the outcome. For more information on disputes and claims"

the key sentance is at the beginning. speak to them again and quote this. emphasise the fact it says "initially have 45 days".
that says to me that they have another course of action availible if you happen to go past 45 days.
 
Paypal wont help one bit, they don't give a crap about anything outside of their posted timelines.

If you use paypal to charge your credit card then call the credit card company and report it as an unauthorised charge and explin they never shipped the item. NO this is not fraud unless you are lying about it.

If you used paypal to pull money from your bank account then call the bank and tell them the same thing as above.

If you used paypal with funds that were in the paypal account already then you are screwed.

Lesson here is never trust anyone and always pay attention to your deadlines on refunds with paypal.
