Iwould like to know if anyone knows or understands workplace law??To make a short story shorter,my company is trying to downsize,instead of doing it right,they are finding ways to get rid of people,by firing them,for very stupid little things.Things that have gone on for years.I just got suspended a day for preventing an accident,i backed up 5 feet,with a laborer on my truck(on the back)of my truck.A mail truck slid and was about to hit me,so i hit reverse and backed up,about 5 feet.My laborer did not jump off,and my boss saw this wrote me up and suspended me 1 day with no pay.Wich is beyyer a truck accident or a fast reversal??
 
Depends on the laws in your state. Florida is a right to work state, so basically you can be fired for any reason, only difference is whether you can collect unemployment. Sounds like time to look for a new job.
 
Not much to try and understand. That's sorta how corporations work. Welcome to America.

it doesn't have to be right, or even make sense for that matter, its the american way,its been that way since the beginning, sad to say but that just the way it is. If we were built on whats the right thing to do,or what makes since.....i don't know what we would be...besides a better place overall
 
I am an HR Manager in NY and may be able to shed some light for you...

Technically speaking your employer can write you up for just about anything. You may agree or dissagree but guess what? It still ends up in your employee file. That is unless you are protected by a union. Based on your post however, it does not sound like you have a union representation. Next, as pointed out above depending on the laws of your state, if terminated you may take your employer to court for wrongful discharge. Be prepared however that this may be a lenghty and an expensive process, and so not always worth the hassle.

Bottom line is that with just a couple of exceptions, you are an employee at will and your employment can be terminated for cause or whithout (employer can lay you off simply because they dont have any work for you). Unless you are being suspended for your religion, skin color, gender, etc., or as a result of some sort of a harrassement, I'm afraid there is not much you can do :(

Yes it is awfull. But on the other hand, that means that your market is flexible. You get kicked out one day, you have new job the next day, because no one is afraid of taking you on board. We in Europe, on the other hand, is hell on earth to fire someone ( except with just cause and even so....). So people will not hire you and unemplyment grows.

There really is no easy solution or totally good system. The US way ( albeit savage ) promotes employment and the economy. Ours, so protective of workers, undermines all the rest...
