anyone have any dwarf snakeheads for sale (the ones that are legal in the US)
 
Im confused. I thought ALL Channa were FEDERALLY banned.

Federal laws trump state laws therefor Channa are illegal in Maryland. Of course I could be wrong.
 
if my memory is correct, you are allowed to keep dwarf snakeheads i remember oddball saying something about it

Maryland adjusted their earlier blanket ban to just Argus and Maculata after the federal ban went into effect.

What does this mean??? It means you can possess dwarf species in Maryland, However, You can not legally import them or transport them across state lines due to the Lacey act regulations.. You will have to find them only in Maryland (and prove it) to be legal and to avoid an up to $10,000.00 fine and five years in a federal prison..
 
The regulations contained in 50 CFR part 16 implement the Lacey Act
(18 U.S.C. 42) as amended. Under the terms of that law, the Secretary
of the Interior is authorized to prohibit by regulation certain
activities involving wild mammals, wild birds, fish (including mollusks
and crustaceans), amphibians, reptiles, and the offspring or eggs of
any of the foregoing that are injurious to human beings, to the
interests of agriculture, horticulture, or forestry, or to the wildlife
or wildlife resources of the United States. The lists of injurious
wildlife species are at 50 CFR 16.11 to 16.15. By adding snakehead
fishes to the list of injurious wildlife, their importation into, and
transportation between, States, the District of Columbia, the
Commonwealth of Puerto Rico, or any territory or possession of the
United States by any means whatsoever is prohibited, except by permit
for zoological, educational, medical, or scientific purposes (in
accordance with permit regulations at 50 CFR 16.22), or by Federal
agencies without a permit solely for their own use, upon filing a
written declaration with the District Director of Customs and the U.S.
Fish and Wildlife Service Inspector at the port of entry. No live
snakehead fish, progeny thereof, or viable eggs imported or transported
under a permit may be sold, donated, traded, loaned, or transferred to
any other person or institution unless such person or institution has a
permit issued by the Director of the U.S. Fish and Wildlife Service.
The interstate transportation of any live snakehead fish or viable eggs
currently held in the United States for any purpose is prohibited
without a permit.

Nope Dwarf Snakheads such as Gachua and Ceylon are LEGAL.

wtf, that's freakin ***.

MD is the state that caused all this snakehead ban in the US and now they are changing the laws saying that you can keep certain ones? i mean, i was a marylander once, but thats just f'd up!
 
Just like Polypterus stated The Lacey act prohibits your from importing/exporting and trafficking them in the country.

Yes states do have rights and can make whatever law they want legal and for the most part the Feds can not touch them, however the catch is the feds just write a new law like the lacey act and then the state laws don not mean jack.

Bottom line is if Maryland says you can have it and the feds say no you lose either way. Don't mess with the feds, just ask Michael Vick.
