I'd say anything that maxes out at 9" would be comfortable in a 40, and anything that maxes out at 6" would look comfortable to you as well in the tank.
 
Just throttle down the output aquastop valve and you will be fine.
 
40 gallon breeder is a great footprint and you have a fair amount of stocking options.

Let's focus in on a tank category... Community, species, planted, etc...

Then focus in on the type of fish you want... Cichlids (African? American? Big? Small?), bottom dwellers, small community fish, etc.
 
If he were to split the output, he should split it into two 1" or 1.25" tubes to reduce velocity and keep the flow up.
