but what he does do which i cant get a good pic of is that he looks like he is trying to gasp for air.. He starts with the lifting of his front thne it kinda ripples down the body but he lifts himself off the sand a bit its hard to explain without seeing

Just to get a little more info to help could you please give us some more info:
Size of tank?
water parameters? (ammonia, nitrite, nitrate)
how often and how much water do you change out?
Are you using tap or r/o and what type of water conditioner?
What are you using for filtration? (powerheads, filters...ect)
What are you using for airation?
How long has your tank been up and running?

OK well ist a 40 gal breeder( i know i know to small he is getting a new tank in a few months). Its been running for about 9 months. I do a weekely water change about 20%. The paremeters are ph-6.0 Am-0 Nitrite-0 Nitrate-20. Hes got 2 over hang filters one is 350 and other 400 by marineland. And i am using tap water but i condition it for about a couple of days.He is got an airling the lenth of the tank 36" i belive. Hope this helps

Are you sure your test kits are accurate. With a ray that is 8 months old I'd expect it to produce more waste than that in a 40 gallon tank with 20% waterchanges a week. I would expect 20% w.c. every 2nd or 3rd day to maintain healthy water quality at least. How big is your ray now? Do you have any pics of your ray?

Yup i am sure they are accurate i went to 2 different pet stores to test the water. And they came up with the same thing. Well i just put some picks of him in my album if u want to look. he is prob the disk size of 7-8in and prob a foot long now he def grew.

Is it bad that he is not producing enough waste..Hes does go to the bathroom i clean it up right away so it doesnt produce any spikes. I hope i am not being to upkeep on him

No I wouldn't worry about to much upkeep. There urea gives off alot of ammonia which you can't clean just do waterchanges to keep the nitrates down. Your ray looks fine in the pics you've taken so I can't really see anything wrong if your parameters are good. There is the one pic where it is swimming at the top of the water which if it is doing alot it is an indication of bad water.
I can't see anything your doing wrong so keep up the good work and good luck with the new tank.

lol that pic of him in the bubbbles he does that to play in them he loves them every time i move them or anything he gets upset...and he doesnt do that that often the pic your talking about is when i frist got him he was just checking the tank
