If he's eating fine then I don't believe he is dying. You either need to get a bigger tank or give him to someone who does. Check out thread that is up now on Oscar that jumped out of tank.
Vibrating of tail and body is a sign of agitation. I have seen my fish do it when they felt threatened by other fish. They aso di it if they see their reflection. If this is what's going on more than likely it is because HE NEEDS A BIGGER TANK.
i am guessing that your oscar is under some kind of stress whether it be water quality temperature or under feeding i do not know
He is agitated by his current living arrangements, which is not appropriate for him, and he would prob be larger than he is after having him a year if he was in an appropriate tank. There is nothing wrong with upgrading as they grow, as it is silly to clean a large tank for a 3 inch fish by himself, but he needs room to grow or he will die.
