Theory is can say no to overtime, but in practice is not easy. Must prove to boss that you have carer responsibility to attend to sexual requirements of father-in-law with Alzheimer's. Even so, if boss willing to substitute for your carer role in looking after your father-in-law's sexual needs, then you will still have to work the overtime.

Generally if you're a temp and don't do what your boss asks, you won't last long. That is the reason for temp work, they can let you go for no reason because you are only obligated to your temp service and/or contract. If you have a true contract for work and refuse to work OT, I would start looking for a new job before your contract expires.
 
Why not call your state labor board with this question. Get yourself some real information instead of the opinionated BS your going to find here. Not to mention when you present info to support your view to your boss, he will be more apt to believe or act on info from a reputable source over a fish forum.

This and call the temp agency and get a copy of the contract since that is who you actually work for and they are the ones who would pay the unemployment.
 
The only reason I know you can be denied unemployment out right is if you haven't worked consistently for six months in a calendar year or if you quit your job. As far as I know at least in NY the burden of proof to deny unemployment is on the employer. As such they essentially have to make a case as to why you don't deserve the benefits, usually they have to prove that you breached their contract or company policy severely or repeatedly and willfully. Violence on the job for instance can cause you to be denied unemployment as well as repeated breaking of company policy but again this is on them to prove. Unless they can prove this to the Labor Board they'll be forced to pay you your benefits. How ever even if they manage to prove it you can appeal the decision several times so give 'em hell! lol!

I myself was fired when I got injured on the job. I was rear-ended by a semi in my work truck en-route to assist one of my subordinates. My back and neck where injured and I was unable to work as my job had physical requirements that I would not be able to meet until I recovered. The doctors estimated a period of 6 months. My employer said I breached my contract as a Supervisor by not being able to work for more than a month and fired me based on breach of contract. They told me that I would be unable to collect unemployment as I had failed to uphold company policy I'll just say they where wrong and I was eligible as well as able to sue them successfully. Companies tell you a lot of bull counting on you being discouraged and not putting up a fight. Do yourself a favor and get informed about your rights, Walmart employees did and they won that suit against Walmart for being forced to do overtime during the holiday season. So again I say do yourself a favor and get informed, you'd be surprised at the legal actions you can take against an employer maybe even a wrongful termination suit. Remember your job is slandering your name and reputation by firing you unjustly and people have sued for that too as it affects their future employment.

Sorry guess I'm still mad about being fired.lol! So my hate is on for employers who take advantage of employees in this struggling economy. They know it's hard to find a job and they scare people and force people to exceed what they where originally hired to do by threatening termination.
 
What kind of job is this? Most of the time these contract type jobs will demand you work what is needed by the employer to get the work done. I work in a warehouse, and the hours vary. I used to be a temp to hire worker before I came FT at a previous job and I had to work what was needed by the employer. There would be weeks where I worked 40 hours and weeks where I worked almost 60 hours or even more. Think about it, your fellow workers are working 50 hours this week and your saying "No, I'm not working OT. I'll just do my 40 and leave". Would you want to keep you as an employee? Your basically denying to do your job. In this day in age I doubt you could get unemployment, but it all depends on what your contract says.

Also, how much OT are they wanting you to work? Are you making a thread on MFK for 5 hours of OT? What are they asking of you....to stay an hour later each day?

Ts needs to get his state's laws right and not depend on fish nerds' opinions although there was some helpful suggestions

When you are using cable, you do not have enough channel choices...
When you do not have enough channel choices you become apathetic...
When you are apathetic, you do not want to work overtime...
When you do not work mandatory overtime you get fired...
When you get fired you wonder about unemployment middle of the night...
When you wonder about unemployment in the middle of the night you discuss with a bunch of people who raise fish with large teeth....
Don't discuss unemployment with people who raise fish with large teeth...
