So I did the dumbest thing I have ever done in my life... I signed the paper work to save my cousins butt from going to jail.

My cousin who is 17 years old was caught shoplifting and I signed him off. The lost prevention officer said I had to sign a civil restitution form stating that Khols has the right to sue me. If I didn't sign any of the paper work my cousin would go to jail for petty theft. I signed all the paper work and told my cousin if I get a restitution letter from Khols I am handing it over to his parents. My cousin acknowledged and said his parents would pay for it. The police were called to pick my cousin up, but luckily I was there to sign the paper work. I spoke to the lost prevention officer and he said my cousin would be charged with petty theft and would not be allowed back into the store. The reason why my cousin called me to sign him off was because he did not want to get into trouble by his parents. I didnt want him to go to jail, but at the same time I should not be held responsible for Khols having the right to sue me. I almost did not sign it, until my cousin pleaded to me that he and his parents will pay for the civil restitution. His parents still doesnt know, but I am thinking of contacting them and let them know about what happen. I dont want to hide this behind their back.

My question is,
-Will my cousin be summoned to court?
-When we signed the paper work we both put our separate address. If my cousin gets a court date, will his summons come to my house or his?
-Since I signed him off being a guardian, would I be liable for his court fee's?
-Will I be liable just for the civil restitution?

He certainly did not learn his lesson, you bailed him out, someone stealing usually has other problems or habbits, could be drugs who knows, you need to tell his parents, if I were his parents and you withheld info like that about my kid i would be furious.

If its petty, as long as he doesn't go back into any khols he's fine, he's a minor so they had had to release him into adult custody, they can sue for what may have been stolen in the past, for example if they discover video footage or further evidence of more theft your liable. I used to be a bad kid, luckily I got the **** kicked out of me by my dad and snapped out of that crap. Hopefully the same happens to him.

Not sure but I doubt the company will move ahead and sue anyone but someone will likely have to pay a fine.

Well just civil restitution such as paying for the wages of the lost prevention officer and what not. They did recover the items he tried stealing.

That's why I predict a fine will be levied against cuz,the merchandise was recovered and probably wasn't damaged...What did he try to steal?

He tried stealing a sweatshirt. I was amazed when he gave me a call that he was at Khols and told me he got caught stealing. He never stole in his life. I guess he was really that desperate to steal it I guess. If he really wanted it he could have just asked me to buy it for him.

A sweatshirt?....sounds like he lost a bet with someone.

Some people don't like asking for hand outs. He will probably have to serve community service or pay a fine and not be allowed to return to the store. If it is his first offence. Personally I would've blowen up his spot to his parents. He should be punished one way or another.
