your right about the un qualified people of any one of those pet stores. i have been in multiple disagreements with a lot of them and really only use one great store 45 min away from me now. there the knowledgeable people who have kept the fish before in there homes and know what they are capable of. when i got my RTC from there they kindly informed me that he will get really huge! i said exactly, and they never questioned me on a size sense it really is not worth the argument in the local chain store. oh and one more good one, i had one of those stores tell me that you cant bread convicts in less then a 75 gallon tank and even then its hard, i've seen them things reproduce in a ten gallon before there even sold from the store :)

i could only imagine if any of us applied there, they certainly would fire us shortly after for making the head execs re-read the books :)

True of petco at least... argueing with the store manager about inadequete animal care is a great way to get a 1 way ticket to the unemployment line.

I am not certain that you either caught the "minimum" qualifier or simply do not understand the word.

That means 39 gallons and your a down right irresponsible fish keeper.

Why does everyone here act like that 40 gallons is meant to be a suggestion of the tank size to home your fish by Petsmart. It is giving you the absolute minimum that is possible!

A 40 breeder is 36" long by 18" wide. If you do daily water changes a 14" adult Oscar can turn around etc.

This also means FOR THIS FISH ONLY! That means if you were to attempt it in a 40 breeder, it is a species only tank.

As in no tankmates, no decor, no substrate and no internal filters (which all would contribute a drop the water volume to below 40 gallons).

I would say that your Petsmart is being semi responsible, while you are not.

Gosh this place irks me with all of the confused idealists and elitists plopping all over.

Just out of curiosity, how much bigger than a 40 gallon breeder was the store display that was containing the Oscar(s)?

I have yet to ever see a LFS with their Oscars on display for sale in over a 40 gallon tank.

There is no law against using a tank larger than the minimum to home your Petsmart purchase.
 
It's about making money. Yes a jail cell is small for anyone but with proper care it can survive plus think of it this way its like living in a jail cell that is clear your whole life not knowing anything else. It's not like these fish Skye one another saying Dan I am in 75 and Jacob saying I got a 220 after leaving petsmart. Now a fish that can't turn around well jail cells you can so no I don't believe in that theory.
