Its diff in every state. When I lived in NY there was no such thing as communities built around lakes thus sealing the lake off from the public .They had to have an area that public could enter.

Even beach front houses had to have an area that public could enter the beach and their yard property only extended so far out onto the beach . Thus leaving lots of sand /beach area for public.

Here that is not the case at all.
Houses ,gated communities are often built around lakes thus no public allowed and their property boundary extends to the water level low tide included .
Even beach houses here the property extend to the edge of the water at low tide.

To bad because some of the best fishing areas are privately owned.

Think its called Reparian laws but either way in some states you can not own/control the water the public which pays taxes just like the home owner must have some type acces to the water but in Florida no such thing.

My brother in law lives around a great lake with huge PB that was public lake 10 yrs ago now ONLY if you own a house there can you access it.
This is unheard of in many states but legal here.
 
I think there efforts should be concentrated on commercial fishing. recreational fishing doesn't dent the ecosystem by comparison. another thing they should do is monitor developments in or near water such as new seaports and artificial islands. half the time those developments destroy vital nurseries for marine and freshwater fish. In MY country , sad as it is to say , there are no regularatory bodies to monitor fishing. no liscenses that regular folk need to register for , and no particular season that commercial fisherman have to abide by. consider that , and the massive developments of man-made islands being buried into the sea around the island , and the pollution caused by so many other factors like petrochemical companies dumping into the ocean... man it's hard just talking about it. 11 years ago Bahrain had the largest ecosystem in the arabian gulf for a myriad of marine species. we had areas being used for manatees as nurseries... man... now it's an underwater desert. there's nothing out there. nothing to conserve , nothing to save... it's shameful that my poeple didn't display a modicum of afterthought. recreational fishing alone would have never created this problem.
 
This administration scares me to death....... they don't have a clue what they are doing....... and if they do, it scares me even more. They want to control every aspect of your life. Next we'll have a task force that takes our names off of customer lists from marine depot, fostersmith, that pet place, bigals etc and start doing "random" searches of are our homes to make sure our fish are on their "approved" lists then they'll be looking around to see what else they can glean from proximity. Did you hear that Frank? They made a child do a chore, they are unfit parents......and what's that? A DOG!! Have you paid your dog taxes sir? Did I see a shot gun in the corner?...... I better write that down, we have a task force for that too. I saw a plastic bottle in your back yard so we have to fine you for that. I saw that you have some drops of oil under your truck. Do you realize that you are ruining the environment? I think the temperature just went up a degree. You are teaching your family to not be environmentally friendly so we'll have to fine you for that too..... We are going to have to take your kids, the shotgun, the dog, and your truck until such a time that we decree you are being a "good" citizen.....Exaggeration? Maybe? But who would have thought it would be offensive to say the Pledge of Allegiance in school? We can pass out condoms and birth control........but don't pray you'll offend someone.....grrrrr..... I can't wait till this guy is out of office along with anyone else on the lunatic fringe....

Now now, before we go Obama slamming lets maybe look into this a bit further. All we've gotten here has been a summary of a snippet of proposed legislation. Certainly its fun to say "I knew better, my vote was right", but you're really not helping to inform anyone about the topic of this post and slinging your political agenda around helps no one in the end.

I'd very much like to know more on the subject if anyone finds anything on the web that I can't. I'll try to be back to post more this evening on the actual subject at hand.
 
So far this, along with proposed legislation in a few North East states to make saltwater fishing licenses mandatory are all I've found. RI by the by shot down a saltwater license proposal. So far I haven't been able to find the legislation that was mentioned in the beginning of this thread, coulkd definitely use some help. Here is the kind of stuff I am finding.


New Legislation Will Protect Recreational Hunting and Fishing on Federal Land

(Columbus) – Two bills introduced by Senator Lisa Murkowski (R- AK) and U.S. Representative Dan Boren (D- OK) will protect recreational hunting, fishing and shooting on land administered by the Bureau of Land Management (BLM) and the U.S. Forest Service.

Backed by the U.S. Sportsmen’s Alliance (USSA), HR 3749 and the Senate legislation are companion bills collectively known as the Recreational Fishing and Hunting Heritage and Opportunities Act. They will prevent situations from emerging where public land is closed arbitrarily for hunting, fishing and shooting, mandating that such closures be done through a reasonable and transparent process.

Specifically, both bills would ensure that:


  • Federal public land managers with the U.S. Forest Service and BLM provide for the use of and access to public lands for hunting, fishing and shooting,
  • An “open until closed” policy is established for the lands managed by the U.S. Forest Service and the BLM unless public and Congressional notification is given,
  • Land managers are urged to lease land for shooting ranges by having the lessee offer suitable assurances to remediate leased lands at the termination of the lease, thus remedying concerns expressed in the past by the BLM over damage to land used for shooting,
  • Skilled volunteers be used on federal public lands not open to hunting when wildlife management requires the culling of animal populations,
  • Congress receives an annual report detailing any closures of land to fishing, hunting, or shooting and the reasons for the closures.
  • “Both bills will guarantee that access for America’s sportsmen to prime public land won’t arbitrarily be denied,” states USSA President and CEO, Bud Pidgeon. “The USSA wholeheartedly supports these bills and urges sportsmen everywhere to contact you members of Congress and urge them to sign on.”
Cosponsors of the Senate legislation are Senators Mike Crapo (R- ID) and Ben Nelson (D- NE).

Cosponsors of HR 3749 are Representatives Marsha Blackburn (R- TN), Kevin Brady (R- TX), Ginny Brown-Waite (R- FL), Paul C.
