Filter placement

Hello I think i have seen this question before but i can not find it anymore. We are moving houses and the new place has a nice place to fit a 55 (that i own) but no where for the canister filter to go below it. So the question is does the filter need to be below the tank or can it be nest to it? about the same level? And if not whay not?

OK but if primed do they need to be below. the top of the filter will be about 4 or 5 inches below the top of the tank is that good enough?
 
i have a 125gal with no stand and i'm running a canister filter right beside it. my water level is about 10inches high and my canister is 16'' high. so, yes it'll work.
