The policy of MFK is and always has been "Buyer Beware". Until this is sorted, I suggest you do the following;

1. Stop bumping the thread.
2. Stop derailing it regardless of the issues.

I would not consider these two members that appear to be ripped off by the original poster to be in violation of the rule you highlighted (Hijacking or derailment of threads will not be tolerated and posts doing so will be deleted.





 
My advice is this.
I have already talked to at least one of the guys that got scammed. So I think it would be ok for me to speak on this as I was also involved with this guys trying to sale me the Fx5.
Now I was not ripped off, I received an email from the guy saying the filter was sold by the time I was ready to do the transaction. So somehow I was, well lets say he was lucky I didn’t also buy this item.
BUT, I also am not in favor of scams. I have dealings with law enforcement (in a good way), know the system, hold a degree in criminal justice and have alot of friends who deal with the law.
If a person knowingly sold an item, and also collected money from two or more persons for the same item, has by law committed fraud. Fraud, with anything over 500 is a felony action in most states (amount can be lower or higher in other states; you need to check your local laws for more information). Furthermore, it is also against the law, and can be a felony since transactions were committed across state lines. Also, since the USPS was also involved in this action, that shipping took place or USPS id tracking numbers were given to so called buyers of this item that is also against Federal law and can be held to that law just for using the USPS numbers to commit above fraud.
There for, just in this one transaction, the seller of this item could and may have committed 1 federal crime, and 2 felony actions just in his state, let alone another state could also charge him for interstate felony transactions across their lines. (this means, not only can the seller be charged in his state for felony fraud, but the buyer(s) state can also charge the person committing the fraud for interstate felony transactions across state lines.)
I would, print any electronic transactions, email or PM messages. Keep these for your records. This way, they can not be lost or del if any accounts were to be cancelled.
two, contact the payment company (credit card, paypal, etc) you made payment with and file a claim.
If you decied to file criminal charges agains him for fraud, you will need any and all information you have to file this charge.
Your local polie department may help, but this could be considered in their eyes as a civil matter if the value is under their amout the laws are for (since its under 500.00)(but some states may be higher or lower, so check with your local law enforcement office) If the local police department will not file any charge, take it to your local DA's office, they will decided if the charge is valid to move forward on.

To the seller, if you have done what everyone says you have done, my advice is to refund both, or any buyer their full amount asap. If there is a item, and it was shipped to one of the buyers, that buyer needs to be given a time line as to when that item will arrive, or a full refund will be given on that date.
