im using a ehiem 2206 i think it is, and a fluval 3 filter top for a powerhead but thats low down so its not breaking the surface

So you have nothing breaking surface tension? Is there any adjustable features on the return, like a spraybar that could be pointed towards the surface? It still seems that this is unlikely the reason you lost fish. Check all your equipment to ensure it is properly functioning and test your water parameters. If you don't have a proper test kit, take a water sample to your LFS, they should be able to test it for you.
