Fx5 Minimum Advertised Price

Not too long ago I purchased a FX5 of of ebay and payed less than $180 delivered to my door. I contacted the ebay seller recently to see if I could purchase another and received this reply:

Effective January 1st, 2008 Monster Pets will not be carrying any Fluval/Laguna products. This is due to Hagen {the manufacturer} demanding that we sell their products for a set price. They are calling this “MAP” pricing {minimum advertised price}. We call it price fixing and refuse to be part of it. Anyone who does not comply with their demands is cut off of from receiving Hagen products. Please feel free to call Marty Lee, the national sales manager of Hagen with any questions or concerns. I apologize to our customers who have been inconvenienced.

Thoughts? Will this be effecting any of the members/vendors who are selling these products here?
 
That's one thing I don't understand anymore how the maufactures are in essence price fixing and not letting the market detrimine value... Examples any iPod, PS3,Xbox ...why when ever you go to different retailers they are all the same price?:nilly:

I'm not a legal eagle far from it, but doesn't this constitute price fixing? Where a manufucturer conspires with a merchant to set or fix prices , in order to enhance profits within a specific geographic area? or would it fall under "restraint of trade" under the "Wilson" act.

It's been a few years since I was in school any lawyers or future lawers on MFK that can explain this?:popcorn:

I'm really not familiar with any of the laws regarding this matter but I am curious to find out.

I am also curious as to what the unit price is for retailers. All of the fx5s that are ebay now have no advertised price or have buy it now prices at or near $299. I paid far lass than that for mine and I'm sure the seller isn't in business to take a loss.

I was talking to a manager at our LFS, he stated his cost on an FX5 was around $150.00 .BTW he was selling his for $399.00 ea (above the suggested $299.00) .Now I don't know if Hagen has different volume price schedules?

i agree, the market should set the price. I have no problem with MSRP or MAP, the issue here is that hagen is not allowing the retailer to sell for less than the MAP
