ill get some pics up in just a mo to help you guys out. some pics are with my new spotted which has quite washed out colours they have been like this since i bought him i thought it was because he was unhappy in a small tank but the dont seem to be returning in comparison to my smaller spotted with the poorly back have a little look and see if you can offer any advice on either of my questions. thanks for the input so far guys very useful
i wouldnt worry so much about the color...gar vary so much in color and pattern, that it's really hard to compare them to one another.
this does sound like a broken back...pretty common in gar keeping. sometimes it will result in the fish being euthanized and other times the fish will heal on it's own. each case is different.

sounds like only time will tell if he straightens up or not....I havent really dealth too much with this myself so I'm not sure as to how long it can take for a broken back to straighten if it does at all.
BTW...after seeing pics, the one with the broken back has a really neat pattern! Another thing to look at though is tankmates....What are all of the tankmates?? tankmates are often the reason for a gar breaking its back. Gar are calm and if they have tankmates that are not, they get spooked more easily.
