No, no band. I'm assuming it went for a fish and landed in the water. They can drown quite easily if they don't have a place to swim to shore as they can't take off from the water, and this lake has no shoreline.

I know it's still quite illegal to have any part of a bald eagle in your possession.

Its illegal to have bird parts, nests, feathers etc. from any non game bird if I'm not mistaken. You could find a blue jay feather by your bird feeder and it would still be against the law to take it.

I think the stick is whats holding the eagle head up. By his beak.
