That can’t be legal.

If it's a manufacturer's discount then they can charge the sales tax of the original price. Generally, the $1/gallon sale is a manufacturer's sale, not the stores. If it's the store's discount, then the tax will be based upon the sale price.
 
You will be taxed at the full price of the tank, and not the $1/gallon price.
This has never happened to me once... Picking up a 40B this week and have already placed pick up order online for $54 and some change as expected... You may want to contact a manager.

So the discount is a store discount of 50% and not $40 for a 40B. In the past, it was a manufacturer's discount, upon which any store can charge you tax based on the store's full price of the item. Petco had Aqueon tanks for $1/g up to 75 gallons, and then went to Tetra tanks due to the $1/gallon costing Aqueon too much money (manufacturer's discount). Come to think of it, this would explain why $1 is only up to 29g with Aqueon tanks now.

They don’t even say anything about 38 gallons. Do they even carry them anymore?
