I can see why he files suit, when he drove the dump truck, he was operating under the capacity of the city as an employee. The the city, as the employer is liable for anything that stems from it. If the city finds that it's the driver's fault, they the city will have to settle that with the driver...... no such things as cancellation of liabilities....

When you work for the city, it does not mean you are barred from filing claims for damages resulting from your city job.

americans and civil law suits go hand in hand here in igloo land if i had an accident with a company car i would have to pay the insurance deductable and probably lose my job.
