Landlord not allowing me to keep my tank.

I don't know about others contract but in our Rental Agreement it always states no pets and a fine per day if the tenant keeps any type of pet/animals on the premises. This is basic for all our contract with an addendum if we allow the tenants to keep pets. I actually read a lot of rental agreement and got ideas from all of them so I as a Landlord is well protected.
 
Just stop paying the rent and let them try to evict you, if you state is anything like mine it will take them a year to get you out. You have just cause as you have no heat or hot water and I'm sure if you look hard enough you can find other things wrong with the house.

was gonna say... not a good idea if you ever want to rent again...let alone play the credit game.... particularly if the police get drawn into it via that way.. then your going to have it on record as being the naughty one. :nono: kinda like your HS grades... its easier to maintain and A then bring up a D.. lol
 
I agree however if there are issues with the property that the landlord has not fixed in a timely manor the tenant has just cause to withhold the rent until those issues are fixed. Also if the problems are documented and the rent that is being withheld is placed in an escrow account I don't believe it can go against you. So you are still paying rent but its not in there hands.

Still doesn't add up. They allowed me to move in with the tank the owners changed renewed our lease and still put it in my lease stating the change in policy and failed to provide documents stating the change and tank size limit.

the lease is the only thing that matters - or a signed addendum to the lease stating the new policy. If it's not in writing, you should win if you sue them... good luck!

The lawyer is claiming that its not in my lease agreement but they didn't even bother to obtain the info to see

I know some other members had issues with this in the past im curious to how they resolved it. Well recently my landlord was in my house for inspection. Everything checked out fine but she is claiming that my apartment complex has a tank size limit of ten gallons. Witch I was never told even before I moved and made it clear to them I will be keeping fish tanks. Now the property manager and owner changed I renewed the lease but wasn't told about this till now.

It is all about the lease ... You said you had new owners and manager ... they're trying to implement new rules.
If you're already operating on an existing lease that hasn't expired ... everything is mute. The lease should specifically state aquarium/fish tank limitations if any. It doesn't fall under PETS, just like waterbeds are specifically named in leases. Should it not say anything about fish tanks at all, then the issue is mute ... tank is allowed by law (check with your lawyer on that one to be sure ... different laws different places)
If this is a lease renewal, and now they want to implement new rules to the lease. They have to allow x number of days for you to relocate or readjust your living situation. I've dealt with landlord/manager/owner changes before ... it sucks. Use your lawyer as a sounding board, you do have a leg to stand on in all this.
But in my honest opinion, I'd start looking for a new place for when said lease is done ... because in the end they'll just screw you on the rent and jack it up.

I checked both pets and miscellaneous and it doesn't specify anything about aquariums or even a size rule.
