Legal Use of Pictures??

We had this discussion on the "fogo peacockbass" thread, my thoughts were removed, I thought psoting someone else's pics without their consent was not right.

It seem it is a pirate's world, anything you want to post is fair game.

Pictures posted on-line do NOT become public domain unless the owner specifically states that as fact.

If the picture is not yours then you have no rights to use it period.

As the owner you can sue anyone who uses your pictures without permission, but it becomes a balance of "damages" vs legal costs. If the scum bag who stole the picture is just re-posting it on-line as their own there isn't much you can do. However, if it's a company who is obviously on-line selling stuff then that's something worth looking into. Talk to a lawyer for sure. If the company is making money then they are in fact a good target for such a lawsuit.

I have had several "copyright protected" works stolen and used illegally and after a few conversations with the people who stole them and the threat of my lawyer being the next call they were promptly removed from use.

Always protect what's yours!

100% right! I am a photographer and have done a bit of research about this. They are using an image that you own the copyright to without your permission commercially. It is illegal. It does not matter if it is on the internet, if it has a watermark, whatever. For something to enter the public domain, or have the copyright expire, the creator either has to say it is public domain, or, the work(photograph in this case) has to be created BEFORE Mickey Mouse(roughly speaking). Disney has lobbied for, and won, to have copyright length extended so that they don't lose the copyrights. I haven't read this whole article, but it talks about it.

Anyone saying otherwise is wrong.

Well I contacted the website and they got back to me promptly and claim they will be removing the picture within a couple weeks. No free fish :-(
 
If we didn't have lawyers we wouldn't need lawyers. :grinno:
